1. Services Provided

American Family Heating & Air Conditioning LLC provides residential HVAC services, including repair, maintenance, and system replacements. All services are subject to availability and acceptance of our estimates or service agreements.

2. Use of Website and Communication Channels
​
By accessing our website or contacting us through phone, email, or SMS/MMS, you agree to:
• Provide accurate and current information.
• Use our services and website only for lawful purposes.
• Not impersonate any person or entity or misrepresent your affiliation with a person or entity.
We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including if we believe a user is in violation of these terms.

3. SMS/MMS Messaging Terms

When you choose to use American Family Heating & Air Conditioning LLC, you are agreeing to receive text messages from us. You agree with the following:
• Message frequency may vary depending on service needs.
• Standard message and data rates may apply.
• You can opt out at any time by replying STOP.
• For support, reply HELP or contact us directly at (540) 891-9091.
We do not sell or share your SMS consent or phone number with any third parties for their marketing purposes.

4. Scheduling & Cancellations

Our arrival time is the first two hours of your scheduled appointment. Please be prepared to welcome us during that two-hour window. As a courtesy, we usually attempt to call or text you 15–20 minutes prior to arrival. We require someone over the age of 18 to always be present at the property during the appointment. Our technicians cannot enter or remain on a property where only minors are present.

Only the legal homeowner may schedule service with us.

If the HVAC system is frozen and we are unable to service it at the time of your scheduled appointment, we will need to reschedule your service. If defrosting the system is necessary, a separate fee will be charged for the defrost service. Additionally, if the system is too frozen to service during the initial visit and we must return at a later time, a separate service/trip fee will be charged to cover the extra time and inconvenience.

Should you need to cancel or reschedule for any reason, please contact our office as soon as possible.
We kindly request 24-hour notice during business days (Monday through Friday) to change or cancel any appointment. For example, if your appointment is scheduled for Monday at 9:00 AM, you must contact us by Friday before 9:00 AM to avoid the $50 cancellation fee. Clients who do not provide at least 24-hour notice during business days or fail to be present for a scheduled appointment WILL be charged a $50 cancellation fee.

The property owner is responsible for maintaining clear and safe access to all work areas, including the indoor unit, outdoor unit, and thermostat, until the scope of work is completed. To ensure safety, children and pets must be kept away from all work areas. To expedite service and ensure safety, it is recommended that anyone NOT affiliated with American Family Heating & Air Conditioning LLC remain clear of the active working area.

American Family Heating & Air Conditioning LLC is not responsible for patching of drywall, ceiling, flooring, roofing, concrete, decorative moldings, finishes, or similar. It also excludes electrical work and/or gas line connections unless specifically included in the scope. The property owner is responsible for all permits and/or calculations should they render necessary.

5. Estimates & Payments

Estimates are available upon request and are valid for a limited time. Final charges may vary based on the actual scope of work performed. Payment is due immediately upon services rendered. Anytime the property owner cannot be available for payment collection, a credit card must be held on file with our office. American Family Heating & Air Conditioning requires all outstanding invoices to be paid PRIOR to scheduling follow-up services and/or repairs. We accept cash, check, and most major credit/debit cards.

Returned checks are subject to a $50 returned check fee. Any unpaid portion more than 30 days in arrears is subject to a 15% APR until paid in full. American Family Heating & Air Conditioning LLC retains title to all equipment and/or materials furnished until final payment is made. If payment is not made as agreed, American Family Heating & Air Conditioning LLC reserves the right to remove said equipment and/or materials. Any damage resulting from said removal shall not be the responsibility of American Family Heating & Air Conditioning LLC.

6. Parts, Equipment & Returns

• All installed parts and equipment are non-refundable.
• Uninstalled special order parts, OEM parts, and equipment are subject to a 25% restocking fee.
• The customer is 100% responsible for all shipping costs, both to and from, for any special order returned or OEM items.

7. Warranties & Disclaimers

Limited Warranty:
All materials, parts, and equipment are warranted only by the manufacturer’s or supplier’s written warranty. Labor performed by American Family Heating & Air Conditioning LLC is warranted for 30 days unless otherwise indicated in writing. We make no other warranties, expressed or implied. Our agents or technicians are not authorized to make any warranties on behalf of the company. Refrigerant and/or drain lines are NOT covered under any warranty, expressed or implied. Shipping of parts and warranty processing fees are not covered under any warranty and are the responsibility of the customer. All warranty work is completed at the sole discretion of American Family Heating & Air Conditioning LLC and will be performed during normal business hours only. Any warranty work performed outside of American Family Heating & Air Conditioning LLC’s normal business hours, will result in homeowner being charged afterhours service fees and labor rates.

8. Limitation of Liability

To the fullest extent permitted by law, American Family Heating & Air Conditioning LLC shall not be liable for any indirect, incidental, or consequential damages arising from use of our services, website, or communications.
